10. Advisory Committee

Goal: To establish an independent group to evaluate the effectiveness of the overall system.

Potential Key Elements:

  1. Program may establish an Advisory Committee that represents a range of stakeholders and interested and engaged persons
  2. Advisory Committee may be authorized to conduct periodic program reviews

Questions:

Who should be represented on an advisory committee?

What functions should the advisory committee perform?

9. Government’s Role and Penalties for Noncompliance

Goal: Government must monitor and enforce performance of producers, retailers and PRO, in terms of consumer protection and adherence to the law.

Potential Key Elements:

  1. Government has ultimate authority and responsibility for oversight, monitoring and enforcement, including addressing noncompliance and fraud
  2. Program specifies monetary and other penalties for failures by parties to comply (e.g., failures to pay deposits, participate in system or accept returned containers)
  3. If program includes stewardship plans, then government to review and approve (or seek amendments) of initial and periodic stewardship plans and annual reports

 

Questions:

What tools should government have to appropriately monitor and enforce compliance with the law?

What is an appropriate monetary and/or other penalty for noncompliance, and for which parties in the system?

8. Outreach and Education

Goal: To have a populace that is educated enough to fully participate in the program with ease, and to have a populace that is fully aware of the economic and environmental benefits of the program.

Potential Key Elements:

  1. Program dedicates funds for outreach and education to consumers, including diverse ethnic populations through translated and culturally appropriate materials
  2. While the redemption rate is one measure of the success of the program, periodic surveys can also be used to assess the public’s understanding of basic program parameters, and to identify gaps, if any

Questions:

What are the key messages to communicate to public?

How can we ensure that the public is sufficiently educated?

7. Public Comment

Goal: To create a mechanism for the public to participate in giving feedback on program design and operations.

Potential Key Elements:

  1. Annual Reports are available to the public
  2. If stewardship plans are part of the process, they are made available for the public to comment on
  3. Program seeks and provides a process for public comment

Questions:

Where/how will the reports be made available?

What should the public comment process look like, and how will the public’s comments be incorporated into future program plans?

What recourse does the public have to ensure the program is operating in a way that ensures consumer protection?
